Terms of Service

1. Who we are

These terms bind Fund and Trade ("we") and the person buying a challenge ("you"). The contracting entity is named at the foot of every page on this site. Questions: support@fundandtrade.com.

2. What you are buying

You are buying an evaluation, and nothing else.

You pay an evaluation fee. In exchange we hand you the credentials of a trading account and measure your activity on it against published rules. If you reach the targets without crossing the limits, we open a funded account for you and pay you a share of the profits made on it.

You are not buying a job, an income, capital, or an investment service. We promise no earnings, and nothing we say should be read as a forecast of your results.

3. Evaluation accounts are simulated

The accounts used in phase 1 and phase 2 are demo accounts. Orders you place on them are not sent to a live market. You deposit no trading capital with us and you cannot lose more than the fee you paid.

The funded account is also simulated. Profits made on it determine a sum we owe you under this contract; they are not your share of real capital that you hold.

4. The rules

The full rules are published on the "Rules" page of this site and form part of these terms. When you buy, a copy of the rules then in force is recorded and attached to your challenge. That copy is what applies to you until your challenge ends, even if we publish different rules afterwards.

5. How loss is measured

This is written out here because it is the commonest source of disputes.

  1. Both loss limits are measured on account equity: your balance plus or minus the result of any open positions.
  2. The daily limit is calculated from your equity as read at the first reading taken from midnight UTC onwards. That starting point is recorded and does not change during the day.
  3. The total limit is a fixed floor below the account's starting balance. It never rises, not even when you are in profit.
  4. Your account is read automatically at regular intervals, on the order of a few minutes. Every reading is timestamped and kept. A decision is only ever taken on a recorded reading, and the reading that caused a decision is given to you on request.
  5. A limit crossed between two readings is recognised at the next one.

6. How a challenge ends

A challenge ends when a loss limit is crossed, when a target is reached and confirmed, or when the account has no closed position for the published inactivity period.

When a challenge ends on a rule - a loss limit crossed, or the inactivity period - the account is frozen: we set its balance to the minimum the broker allows, which leaves no margin to trade with, and any position still open is closed out by the broker. The account password is then changed and the account is archived. You are told.

This takes effect at the broker, so it lands within minutes rather than instantly, and we do not close your positions ourselves. Anything traded after the timestamp of the reading that ended the challenge does not count, in either direction.

When a challenge ends because you passed, the account is not frozen: its password is changed and it is archived with its balance intact, because that balance is the record of your result.

7. Paying the fee

Fees are payable in FCFA by Mobile Money through a payment provider. An unpaid order expires automatically after 72 hours.

Fees are non-refundable once the account credentials have been handed over, the purchased service having then been delivered. If you were charged and no account was handed over, write to us with the order reference: that is our error and we fix it.

A discount code is personal, single use, tied to your Mobile Money number, valid on a first challenge and never combined with another.

8. Identity verification

Before a funded account is opened we verify your identity. The name must match the registered Mobile Money account. One identity document can carry only one funded account.

9. Payouts

You keep the profit share published on the "Rules" page. A payout is requested at the end of a cycle and is approved manually by an operator. Payments are made in FCFA to the Mobile Money number registered on your account, and to no other. The conversion rate applied is recorded on your request.

A refused payout comes with a reason.

10. What you may not do

  • Open more than one account, in your name or through anyone else.
  • Coordinate your positions with another account so as to turn an evaluation into a risk-free bet, including by taking opposing positions.
  • Exploit a technical fault, latency, or a manifestly erroneous quote.
  • Give your credentials to anyone, or trade anyone else's account.

We will never ask you for your trading password, through any channel.

11. Suspension

We may suspend an account for a breach of clause 10 or where the law requires it. A suspension comes with a reason and you may dispute it in writing; we answer with the evidence the decision rests on.

12. Liability

Our liability in respect of a challenge is limited to the fees you paid for that challenge, and to sums owed under an approved payout. Nothing here excludes liability that cannot be excluded under applicable law.

13. Changes

A change to these terms applies to purchases made after it is published. It does not change the rules attached to a challenge already bought.

14. Governing law

To be settled with our legal advisers before sales open, taking account of the law of the contracting entity's country and of Cameroonian consumer protection.
